When someone in your family passes away, with a will or without one, their estate may have to go through Georgia probate court before anything can be distributed. Most families do not know what that process looks like until they are already in the middle of it.
Understanding probate ahead of time can help your family feel prepared instead of overwhelmed. Here is what the process generally looks like, and what you can do now to protect your family from unnecessary delays.
Step 1: Filing the Petition
Probate begins when someone, usually a family member or the executor named in the will, files a petition with the probate court in the county where your loved one lived.
Step 2: Notifying Heirs and Creditors
The court requires that all heirs and any known creditors be notified of the probate proceeding. This gives anyone with a legal interest in the estate the opportunity to respond.
Step 3: Appointing an Executor or Administrator
If there is a valid will, the court typically appoints the executor named in the document. If there is no will, the court appoints an administrator, often a close family member, to manage the estate.
Step 4: Inventory and Appraisal
The executor or administrator is responsible for identifying and valuing all assets in the estate, including property, bank accounts, and personal belongings.
Step 5: Paying Debts and Distributing Assets
Before any assets are distributed to heirs, outstanding debts and taxes must be paid from the estate. Once that is complete, the remaining assets are distributed according to the will, or according to Georgia law if there is no will.
How Long Does It Take?
Probate in Georgia can take anywhere from a few months to over a year, depending on the size of the estate, whether there are disputes among heirs, and whether the will is contested.
