5 Legal Documents Every Family Should Have

Before an emergency happens is the only time you have a choice. Once a crisis hits, whether it is a medical emergency, an unexpected death, or a sudden incapacity, the decisions are no longer in your hands unless the right documents are already in place.

This is not about being old or wealthy. It is about being prepared. Here are five legal documents every family should have, and what each one actually does to protect you, your home, and everyone you love.

1. A Last Will and Testament

Your will determines who receives your property and assets after you pass away. Without one, Georgia law decides for you, and the outcome may not reflect what you would have wanted.

2. A Durable Power of Attorney

This document names someone you trust to manage your financial and legal affairs if you become unable to do so yourself. Without it, your family may need court approval just to access your accounts or pay your bills.

3. A Healthcare Directive

Also known as an advance directive, this document outlines your medical wishes and names someone to make healthcare decisions on your behalf if you cannot communicate them yourself.

4. A Deed Reflecting Proper Property Ownership

Many families discover too late that their property deed does not reflect how they intended ownership to pass down. A properly recorded deed can prevent confusion and protect against heirs’ property issues down the line.

5. A Beneficiary Designation Review

Bank accounts, retirement accounts, and life insurance policies often pass outside of a will, based entirely on the beneficiary listed on the account. Reviewing and updating these regularly ensures they reflect your current wishes.
